Regarding the "Nation of Islam", their official doctrine is that Allah appeared in the form of a human being named Fareed Muhammad, and that this "incarnation of God" chose another man, called Elijah Muhammad, as his Prophet. This is a clear contradiction of the Monotheistic faith (Tawhid), and of the Qur'anic teaching according to which Muhammad (blessings and peace upon him) is the Seal of the Prophets. That is enough to say that everyone who belongs to the "Nation of Islam" is not, ipso facto, a Muslim, but an unbeliever.We still never cease to be amazed by the apparent sharia authority of an imam in Italy, in this case, to make a religious pronouncement about someone in another country.
Muslims must declare this truth, and each one of them who keeps silent while listening to Mr. Farrakhan being called "a Muslim leader" is sinning. Since the matter concerns "faith and unbelief," it is not permitted to avoid a judgment due to political or diplomatic considerations. Every marriage between a Muslim and a member of the "Nation of Islam" is null and void, and whoever, after becoming a member of this organization, wants to return to Islam, must repent and be re-converted. In case he was married, he must re-celebrate his wedding; in case he performed the Pilgrimage, he must perform it again.
This could be interpreted as a mere adjudication of status vis-a-vis non-Italian Muslims. This fatwa does not go so far as to say that pursuant to the issuer's authority any punishment may be meted out.
That said, this fatwa is clear in its reasoning and free of the hysterical calls for extreme punishments for people affected by it, although it does set up a stark conflict between (a) the sharia and (b) the laws of any state in the U.S. under which a marriage between a NOI member and a real Muslim has been recognized.
From the American perspective it is worth emphasizing that American law, not the sharia, is what determines the validity of a marriage in the U.S.
Ayatollah Khomeini's fatwa against Salman Rushdie, however, is another story:
Those wounded Islamic sanctities again!In the name of God Almighty. There is only one God, to whom we shall all return. I would like to inform all intrepid Muslims in the world that the author of the book entitled The Satanic Verses, which has been compiled, printed, and published in opposition to Islam, the Prophet, and the Qur'an, as well as those publishers who were aware of its contents, have been sentenced to death. I call on all zealous Muslims to execute them quickly, wherever they find them, so that no one will dare insult the Islamic sanctities. Whoever is killed on this path will be regarded as a martyr, God willing. In addition, anyone who has access to the author of the book, but does not possess the power to execute him, should refer him to the people so that he may be punished for his actions. May God's blessing be on you all.
Death to you and you and you.
This was one . . . chilling . . . personality, and the implications of this are mighty chilling too. People actually were killed as a result of this ridiculous "fatwa."
Effectively, then, there is no such thing as jurisdiction in the sharia. Apparently, the most ignorant, self important, jumped up Sudanese imam can order the deaths of a Key West blasphemers and give anyone who dies in the attempt to carry out the sentence of death a free ticket to paradise.
We have emailed Shaykh 'Ali Mo'allim Hussento ask him to answer the following questions on these matters:
- How is it that you have the religious authority to issue a fatwa affecting a matter that is in another country?
- Are there no American imams who can see the same things you do and issue a fatwa affecting the NOI?
- What if your fatwa conflicts with a fatwa of an American imam? Who or what determines which fatwa will be recognized?
- Ayatollah Khomeini's fatwa against Salman Rushdie and his publishers purported to exercise an authority to order Muslims in other countries to murder these people, contrary to the laws of those countries. Do you believe you also have the authority to order someone killed if, for example, you believe that that person is guilty of apostasy?
- Who is entitled to carry out a sentence of death when a person is determined to be an apostate?
- What must happen in Dallas, Texas, for example, before a Muslim there can kill someone in Dallas who is an apostate?
- Who has the right to determine that that person is an apostate? Any Muslim, or only an imam?
- What qualifications must an imam have under the sharia in order to have the authority to order someone in Texas to be murdered for apostasy?
- Is it "murder" for a person to be killed for apostasy in Texas when Texas law does not recognize a killing for this reason as a legal justification for killing?

I'm amazed this didn't happen decades ago. Nation of Islam is nothing more than a cult. No Islamic country or organization anywhere in the world acknowledges it as Muslim. Not even that 7th century madman Muhammad taught that there were flying saucers orbiting the earth and protecting him from harm.
